Terms and conditions SAH Trading BV


Article 1. Applicability

These terms and conditions apply to all our offers, to all agreements entered into by us of SAH Trading BV  trading from the website seetcuvers.eu. In particular, these terms also apply to agreements entered into by us to supply items to our customer.

‘Customer’ means any visitor to the internet site or any natural or legal person who, until we are in a contractual relationship under a purchase agreement concluded with us, or wishes to enter into another type of agreement.

By using the internet site of www. seetcuvers.eu and/or placing an order, the customer accepts these terms and conditions as well as all other rights and obligations as stated on the internet site(s).

Derogation from the terms and conditions laid down in these terms and conditions may be made only if this has been expressly agreed in writing. If the customer also refers to his terms and conditions, those terms do not apply.

SAH Trading BV reserves the right to amend or supplement these terms and conditions.

Article 2. Agreement

An agreement is reached when an order confirmation of an order issued by the customer has been emailed to the email address provided by the customer. The customer and SAH Trading BV expressly agree that by using electronic forms of communication, a valid agreement is reached once this order confirmation has been sent to the customer. The electronic files of  SAH Trading BV are hereby count as proof.

The order confirmation sent by us to the customer is deemed to fully and accurately reflect the content of the contract. The customer is expected to agree to the content of our order confirmation unless, within 8 days of the date of our order confirmation, she indicates in writing to us that she cannot agree with the content.

Information, images and communications both oral and written regarding the main characteristics of the products are given as accurately as possible. Deviations in weights, dimensions, colours, etc. apply only approximately, are indicative and in principle cannot be grounds for compensation or dissolution. Images on the picture may differ from the real color in terms of color.

Any additional agreements and/or commitments made and/or made by our employees will only bind us if these agreements and/or commitments have been confirmed in writing by us.

Article 3. Prices

Our prices are in euros including VAT and excluding shipping costs, unless expressly and in writing otherwise agreed.

The current prices are those prices listed on the internet site during the time of the order, possibly previously published prices expire.

After the conclusion of the agreement, prices will not be increased unless the price increase is the result of legislation or provisions.

All prices on the internet site are subject to printing and typing errors. No liability is accepted for the consequences of printing and typing errors.

Special offers are valid only for the period of validity as stated on the internet site in relation to that special offer and/or as long as the stock lasts. Listings do not automatically apply to reorders.

The amount of shipping and administration costs is listed on the internet site, and applies to delivery within the Netherlands.


Article 4. Payment

All payment options are listed on the internet site seetcuvers.eu.

Payment must be made in Euro.

If the customer does not make (general) payment in time, he is in default without any further default. In that we have the right to suspend delivery.

Contracts for which any payment due two weeks after the conclusion of the agreement has not been fulfilled shall automatically expire.

Article 5. Shipping and delivery

SAH Trading BV has the most items in stock. As a rule, we send the ordered items within two (2) working days of receipt of the payment.

If a product is completely or partially out of stock, contact will be made with the customer. Products that are no longer in stock are returned to the customer free of charge or the monies already paid, worth the products no longer in stock.

The specified delivery times are indicative, exceeding the delivery time never entitles the customer to compensation. The customer is entitled to cancel the order or terminate the contract if the delivery time has been exceeded by more than 14 days. Any funds already paid will be returned by SAH Trading BV.

Delivery takes place at the address specified by the customer during the conclusion of the agreement.

The customer is responsible for the accuracy and completeness of and is responsible for the data she has provided us. If you are unable to deliver due to incorrect customer data, any additional delivery costs may be charged.

Different conditions may apply to deliveries abroad.

The customer is required to purchase it within the agreed time.

If the customer defaults to receive the products, the resulting damage and costs are for his/her account. This also applies to the refusal of cash on delivery; in this case, the customer is obliged to reimburse the shipping and administration costs and cash on delivery costs.

The delivery of the products is made via Post, unless otherwise indicated on the order form. Shipping costs are borne by the customer, unless otherwise agreed. When selected for regular mail shipping, SAH Trading BV is not liable for loss, theft or damage to the order at the hands of Post nl. There is also the possibility to pick up the order, as a result, shipping costs will be cancelled.

Any returns to SAH Trading BV are on behalf of the customer, must be made free of charge and under written declaration of reasons..

By accepting the goods to be delivered, the customer agrees with the quality and quantity of these goods and at that time the ownership and risk passes to the customer. Should the customer unexpectedly receive a damaged order, the customer must inform SAH Trading BV within 2 working days of receiving the order. In the event that the fault lies with SAH Trading BV,  the products will be repaired/replaced free of charge. The customer must return the items sufficiently franked to  SAH Trading BV.. If you fail to inform SAH Trading BV regarding transport damage or if you do so too late, your right to warranty will expire.

Article 6. Cooling-off period and returns

To the extent otherwise indicated, you have the right, without giving reasons, to return the items within a period of 7 working days. However, it is emphatic that the items are delivered to SAH Trading BV in pristine condition. If this aspect is not taken into account, we will unfortunately not be able to take back the items and cancel the payment. This in accordance with the Distance Selling Act.

Any payments made will be returned within 14 days.

There is no claim for a refund if the product is not notified in writing, is used, damaged, a damaged package has, is not returned in the original packaging, is not returned properly and properly packaged and/or the original purchase note is missing. If one or more of the above points apply to a return, or the law determines otherwise, you will be charged for the return/cancellation of your order. The amount of these costs will be assessed and determined by SAH Trading BV.

The costs for the return are at the customer’s expense.

Article 7. Retention

Items supplied by us will remain our property until the time of full payment of all that the customer owes us.

The risk to the products already passes when the products have been made available to the carrier by SAH Trading BV.  SAH Trading BV offers the possibility to insure transport; insurance costs are charged for this. The amount of the insurance costs is listed on the internet site.

Article 8. Guarantee and liability

The customer has an obligation to check on delivery whether the products comply with the agreement. If this is not the case, the customer should inform SAH Trading BV thereof as soon as possible and in any case within two (2) days of delivery, in writing and motivated, on pain of the customer’s right to expire.

If it has been shown that the products do not comply with the agreement, SAH Trading BV has the choice to replace the products in question with new products or to refund the invoice value thereof, without the other party being entitled to compensation.

SAH Trading BV  gives  a 7 day warranty on the purchased items, provided that the item is normally used. Please contact  SAH Trading BV .in writing at alltimes. This guarantee does not apply in cases where items have not been properly prepared, handled, used, retained, or maintained or have used or handled the items under circumstances or for purposes other than those provided by us. Discoloration by e.g. contact with water, cleaning products, cosmetics, perfume, perspiration and the like are also excluded. The applicability of the warranty is solely for the assessment of diamond shelicence  SAH Trading BV..

We are never liable for consequential or business damage, direct – or indirect damage, including loss of profit and downtime – suffered by the customer or third parties resulting from whole or partial after-charge deliveries of products, delayed or unsubstantiated delivery, or the lack of delivery of products or by the products themselves.

We are never required to pay any damages to the customer.

If, for whatever reason,SAH Trading BV is required to compensate for anydamage, the compensation will never exceed an amount equal to the invoice value in respect of the product or service causing the damage.

Article 9. Force majeure

In case of force majeure, SAH Trading BV is not obliged to fulfil its obligations to the customer, or the obligation is suspended for the duration of the force majeure.

Force majeure means any situation in which Two  Brothers Import B.V. is unable to fulfil its obligations or part of it due to circumstances beyond the fault of  SAH Trading BV. Such circumstances include strikes, fire, business failures, power failures, non-timely supply of suppliers or other third parties involved and the absence of any government-obtained permit. Force majeure is also understood to mean failures in a (telecommunications) network or connection or used communication systems and/or the at any time unavailable from the internet site.

Article 10. Personal data

The data provided by the customer is registered by Two  Brothers Import B.V.  in accordance with the Personal Data Protection Act and is used only to provide the requested information or to deliver the ordered items to the correct place of destination; to promote the user-friendliness of the site; to be able to make personal offers and promotions or to provide information or news bulletins relevant to the customer.

The data will under no circumstances be provided to third parties.

Article 11. Applicable Law and Disputes

The agreements we enter into and these delivery conditions are limited to Dutch law.

All disputes of any kind related to/resulting from agreements entered into by us and deliveries made by us are brought to justice by the competent court in the Netherlands.

Article 12.

It is not permitted to take over, multiply      or use images, photos, texts or otherwise from the internet site(s) of SAH Trading BV. .

seetcuvers.eu is a online shop of SAH Trading BV,which is located in Amsterdam and registered with the Chamber of Commerce under number  20085706.

Customer complaints relating to defects in a product supplied by SAH Trading BV must be notified to us by the customer within 8 days of delivery. This should be done by e-mail  rowi@seetcuvers.nl containing a clear precise description of the complaint and specifying the order number with which the products in question were ordered.
